The law in Florida
DraftKings and FanDuel both offer salary-cap DFS in Florida, which has no law specific to DFS. A 1991 attorney general opinion said paid fantasy leagues violate the state's ban on betting on contests of skill, and the Gaming Control Commission has sent cease-and-desist letters to fantasy operators, but no Florida court has ruled on the question. Pick'em here is mostly peer-to-peer (PrizePicks, Underdog, Sleeper and Betr); only Dabble still lists house-style contests. Players must be 18 or older.
Recent changes: March 2026: a gambling bill (HB 189, passed by the House as an amendment to SB 1580) that would have allowed fantasy contests meeting skill-based conditions, without a licensing system, died when the session ended on March 13, so DFS remains unregulated. DraftKings launched peer-to-peer Pick6 here in January 2026. Oct 8, 2026: the Seminole Tribe sued DraftKings in state court, claiming Pick6 and DraftKings Predictions are illegal sports betting.
